Turkey has recently introduced legislation that requires importers and manufacturers of chemical substances to notify them to the Turkish authorities. If you place on the market in Turkey substances or mixtures/preparations/formulations these requirements may well affect you. You will need to understand the regulatory requirements and, if appropriate, make a notification in Turkish using the IT tools made available by the Turkish authorities.

The deadline for importers and manufacturers to register their chemical substances with the Turkish authorities is 31st March 2011.

Background information

Requirements

Substances manufactured in, or imported into, Turkey, on their own or in preparations, in quantities greater than 1 tonne are required to make a submission each year. There are a few exemptions that could apply.

There are two tonnage bands:

1 - 1000 tonnes per annum and
>1000 tonnes per annum

No information is required for substances manufactured, or placed on the market, in quantities of less than 1 tonne per importer or manufacturer.

The scope of the information required for a >1000t notification is relatively extensive whereas for a 1 - 1000 t notification the information required is quite basic. Updates of notifications are required in certain cases and some information may be requested to be kept confidential.

The Government authorities in Turkey will develop a priority list of notified substances and conduct a risk assessment on them; this risk assessment may require notifiers to provide further data and could lead to risk management measures being imposed.

The Regulation

The Turkish Regulation on "Inventory and Control of Chemicals"" was published on 26 December 2008 and entered into force on 1 January 2009. It was amended on 10 November 2009 to extend the submission deadline to 2010 and added polymers to the list of exemptions. The timing of this regulation and some of the content makes many believe that it is strongly influenced by REACH but it actually has far more in common with the Existing Substances Regulation (ESR - EEC 793/93) which was repealed by REACH effective from 1 June 2008.
